Applicable data protection law
The following apply to data processing in connection with this website: the General Data Protection Regulation (GDPR) of the European Union, because our offer is also directed at persons in the EU (article 3 paragraph 2 letter a GDPR), and the Swiss Federal Act on Data Protection (FADP), because our registered office is in Switzerland.
Where we store information on your device or access such information (for example cookies), we also observe the ePrivacy requirements, in Germany section 25 of the TDDDG. Where this policy cites legal bases under article 6 GDPR, this serves transparency towards users in the EU; the information duties under articles 19 et seq. FADP are likewise covered by this policy.
Hosting and server log files
Our website is hosted by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Deutschland (“Hetzner”). Processing takes place in Hetzner data centres in Germany and Finland; hosting does not involve any transfer to countries outside the EU or EEA. We have concluded a data processing agreement with Hetzner pursuant to article 28 GDPR. When you access our website, Hetzner automatically processes information on our behalf in what are known as server log files, transmitted by your browser:
- IP address of the requesting device
- date and time of access
- page or file requested
- volume of data transferred and HTTP status code
- browser type and version, operating system (user agent)
- previously visited page (referrer URL)
Purpose and retention of log files
This data is technically necessary to deliver the website. We process it to ensure trouble-free operation, to safeguard system and information security and to analyse faults. The legal basis is our legitimate interest in the secure and stable provision of the website (article 6 paragraph 1 letter f GDPR). This data is not combined with other data sources and is not evaluated for marketing purposes.
Log files are deleted as soon as they are no longer required for the purposes stated, as a rule after 30 days at the latest; individual records are retained longer only where a security-relevant incident requires it.
Contacting us
If you contact us by email, we process the data you provide (your email address, your name where given, and the content of your message) in order to handle and answer your enquiry.
The legal basis is article 6 paragraph 1 letter b GDPR where your enquiry is aimed at concluding or performing a contract (including pre-contractual enquiries, for example about our product), and otherwise our legitimate interest in responding to enquiries addressed to us (article 6 paragraph 1 letter f GDPR).
We delete your enquiry once it has been conclusively handled and no statutory retention obligations prevent deletion.
Disclosure and categories of recipients
We only disclose your personal data where described in this policy or permitted by law. The categories of recipients are:
- IT and hosting service providers acting for us as processors pursuant to article 28 GDPR
- authorities, courts or legal advisers, where necessary to comply with legal obligations or to assert, exercise or defend legal claims (article 6 paragraph 1 letter c or letter f GDPR)
Transfers to third countries
As a Swiss company we process your data primarily in Switzerland and, through our hosting provider, in the European Union. The European Commission has confirmed an adequate level of data protection for Switzerland by adequacy decision; conversely, Switzerland recognises the states of the EU and the EEA as countries with an adequate level of protection. Transfers between Switzerland and the EU or EEA are therefore permitted without further safeguards. No transfer to other third countries takes place.
Retention periods
Where this policy does not state a specific retention period, we store personal data only for as long as necessary for the respective purpose. We then delete the data unless statutory retention obligations (for us as a Swiss company in particular the ten-year retention obligation for business records under article 958f of the Swiss Code of Obligations) or the limitation of possible legal claims require longer retention.
Your rights
You have the following rights in relation to us:
- access to the personal data we process (article 15 GDPR)
- rectification of inaccurate or incomplete data (article 16 GDPR)
- erasure of your data (article 17 GDPR)
- restriction of processing (article 18 GDPR)
- data portability (article 20 GDPR)
- withdrawal of consent at any time with effect for the future (article 7 paragraph 3 GDPR)
Right to object and to lodge a complaint
Right to object (article 21 GDPR): you have the right, on grounds relating to your particular situation, to object at any time to processing of personal data concerning you which is based on article 6 paragraph 1 letter f GDPR (legitimate interest). We will then no longer process the data unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
An informal message to the contact details above is sufficient to exercise your rights.
Right to complain: you have the right to lodge a complaint with a data protection supervisory authority (article 77 GDPR), in particular in the EU member state of your habitual residence, place of work or the place of the alleged infringement.
Rights under the Swiss FADP: if you are located in Switzerland, you have in particular the right of access (article 25 FADP), the right to data disclosure and transfer (article 28 FADP) and the right to rectification and erasure (article 32 FADP). You may also contact the Federal Data Protection and Information Commissioner (FDPIC) at www.edoeb.admin.ch.
No automated decision-making
Automated decision-making including profiling within the meaning of article 22 GDPR does not take place on this website.
Providing your personal data is neither required by law nor by contract. You can visit our website without actively providing data; only the technical data described above is generated. Without your contact details, however, we cannot answer enquiries.
Changes to this privacy policy
We adapt this privacy policy when data processing on our website or the legal requirements change. The version published on this page applies in each case.
